The San Bernardino County District Attorney’s Office has filed charges against Dwayne Charles Hammer (Age 25 of Hesperia).
CASE SYNOPSIS
On Thursday, July 23, 2020, deputies from the San Bernardino County Sheriff’s Department responded to a motel in the 15700 block of Mojave Drive in Victorville, regarding a disturbance. During their investigation, Dwayne Charles Hammer was arrested after resisting the deputies.
Our office has reviewed this case and charged Hammer with violating the following sections of the California Penal Code:
Penal Code Section 273a(b) – Cruelty To Child By Endangering Health
Any person who, under circumstances or conditions other than those likely to produce great bodily harm or death, willfully causes or permits any child to suffer, or inflicts thereon unjustifiable physical pain or mental suffering, or having the care or custody of any child, willfully causes or permits the person or health of that child to be injured, or willfully causes or permits that child to be placed in a situation where his or her person or health may be endangered, is guilty of a misdemeanor.

Penal Code Section 245(a)(1) – Assault With A Deadly Weapon
Any person who commits an assault upon the person of another with a deadly weapon or instrument other than a firearm shall be punished by imprisonment in the state prison for two, three, or four years, or in a county jail for not exceeding one year, or by a fine not exceeding ten thousand dollars ($10,000), or by both the fine and imprisonment.

Penal Code Section 148(a)(1) – Resist, Obstruct, Delay Of Peace Officer or EMT
Every person who willfully resists, delays, or obstructs any public officer, peace officer, or an emergency medical technician, as defined in Division 2.5 (commencing with Section 1797) of the Health and Safety Code, in the discharge or attempt to discharge any duty of his or her office or employment, when no other punishment is prescribed, shall be punished by a fine not exceeding one thousand dollars ($1,000), or by imprisonment in a county jail not to exceed one year, or by both that fine and imprisonment.
