The San Bernardino County District Attorney’s Office has charged Douglas Kircher (Age 36 of Yucaipa) with multiple crimes, including the attempted murder of two deputy sheriffs.


CASE SYNOPSIS

On Friday, September 11, 2020, at about 12:46 am, deputies from the San Bernardino County Sheriff’s Department responded to a call of shots fired in the 13300 block of Roberts Road, in Yucaipa. At the conclusion of the investigation, Douglas Kircher was arrested.

After reviewing this case, our office has filed charges against Mr. Kircher for violating the following sections of the California Penal Code:

Penal Code Section 664/187(a) – Attempted Murder (Felony)
Murder is the unlawful killing of a human being, or a fetus, with malice aforethought.

Penal Code Section 246 – Shooting At An Inhabited Dwelling, Occupied Motor Vehicle, Occupied Aircraft, etc. (Felony)
Any person who shall maliciously and willfully discharge a firearm at an inhabited dwelling house, occupied building, occupied motor vehicle, occupied aircraft, inhabited housecar, as defined in Section 362 of the Vehicle Code, or inhabited camper, as defined in Section 243 of the Vehicle Code, is guilty of a felony, and upon conviction shall be punished by imprisonment in the state prison for three, five, or seven years, or by imprisonment in the county jail for a term of not less than six months and not exceeding one year.

As used in this section, “inhabited” means currently being used for dwelling purposes, whether occupied or not.

Penal Code Section 246.3(a) – Discharge A Firearm With Gross Negligence (Felony)
Except as otherwise authorized by law, any person who willfully discharges a firearm in a grossly negligent manner which could result in injury or death to a person is guilty of a public offense and shall be punished by imprisonment in a county jail not exceeding one year, or by imprisonment pursuant to subdivision (h) of Section 1170.

Penal Code Section 594(a) – Vandalism Over $400 Damage (Felony)
Every person who maliciously commits any of the following acts with respect to any real or personal property not his or her own, in cases other than those specified by state law, is guilty of vandalism:

(1) Defaces with graffiti or other inscribed material.
(2) Damages.
(3) Destroys.

Whenever a person violates this subdivision with respect to real property, vehicles, signs, fixtures, furnishings, or property belonging to any public entity, as defined by Section 811.2 of the Government Code, or the federal government, it shall be a permissive inference that the person neither owned the property nor had the permission of the owner to deface, damage, or destroy the property.

Penal Code Section 69 – Resisting An Executive Officer (Felony)
Every person who attempts, by means of any threat or violence, to deter or prevent an executive officer from performing any duty imposed upon the officer by law, or who knowingly resists, by the use of force or violence, the officer, in the performance of his or her duty, is punishable by a fine not exceeding ten thousand dollars ($10,000), or by imprisonment pursuant to subdivision (h) of Section 1170, or in a county jail not exceeding one year, or by both such fine and imprisonment.

(2) Counts

Penal Code Section 314(1) – Indecent Exposure (Misdemeanor)
Every person who willfully and lewdly, either:

1. Exposes his person, or the private parts thereof, in any public place, or in any place where there are present other persons to be offended or annoyed thereby; or,
2. Procures, counsels, or assists any person so to expose himself or take part in any model artist exhibition, or to make any other exhibition of himself to public view, or the view of any number of persons, such as is offensive to decency, or is adapted to excite to vicious or lewd thoughts or acts, is guilty of a misdemeanor.

Penal Code Section 29800(a)(1) – Possession Of A Firearm By A Felon
Any person who has been convicted of, or has an outstanding warrant for, a felony under the laws of the United States, the State of California, or any other state, government, or country, or of an offense enumerated in subdivision (a), (b), or (d) of Section 23515, or who is addicted to the use of any narcotic drug, and who owns, purchases, receives, or has in possession or under custody or control any firearm is guilty of a felony.

Penal Code Section 30305(a)(1) – Unlawful Possession Of Ammunition
No person prohibited from owning or possessing a firearm under Chapter 2 (commencing with Section 29800) or Chapter 3 (commencing with Section 29900) of Division 9 of this title, or Section 8100 or 8103 of the Welfare and Institutions Code, shall own, possess, or have under custody or control, any ammunition or reloaded ammunition.
