The San Bernardino County District Attorney’s Office has charged Elisha Jones (Age 24 of Madera) and Heaven Ramirez (Age 20 of Fort Irwin) with child abuse.


CASE SYNOPSIS

On Monday, September 14, 2020, detectives from the San Bernardino County Sheriff’s Department initiated a child abuse investigation that had occurred at Fort Irwin. A four-month-old victim was transported to Loma Linda University Medical Center with significant injuries. During the investigation, Heaven Ramirez and Elisha Jones were arrested.

After reviewing this case, our office has charged Ms. Ramirez with violating the following section of the California Penal Code:

Penal Code Section 273a(a) – Child Abuse Under Circumstances or Conditions Likely To Cause GBI or Death (Felony)
Any person who, under circumstances or conditions likely to produce great bodily harm or death, willfully causes or permits any child to suffer, or inflicts thereon unjustifiable physical pain or mental suffering, or having the care or custody of any child, willfully causes or permits the person or health of that child to be injured, or willfully causes or permits that child to be placed in a situation where his or her person or health is endangered, shall be punished by imprisonment in a county jail not exceeding one year, or in the state prison for two, four, or six years.

Mr. Jones has been charged with violating the following sections of the California Penal Code:

Penal Code Section 273ab(b) – Assault On A Child Becoming Comatose/Paralysis (Felony)
Any person, having the care or custody of a child who is under eight years of age, who assaults the child by means of force that to a reasonable person would be likely to produce great bodily injury, resulting in the child becoming comatose due to brain injury or suffering paralysis of a permanent nature, shall be punished by imprisonment in the state prison for life with the possibility of parole. As used in this subdivision, “paralysis” means a major or complete loss of motor function resulting from injury to the nervous system or to a muscular mechanism.

Penal Code Section 206 – Torture (Felony)
Every person who, with the intent to cause cruel or extreme pain and suffering for the purpose of revenge, extortion, persuasion, or for any sadistic purpose, inflicts great bodily injury as defined in Section 12022.7 upon the person of another, is guilty of torture.

The crime of torture does not require any proof that the victim suffered pain.
