The San Bernardino County District Attorney’s Office has charged Barnard Lamar Saddler (Age 23 of San Bernardino) and Kenneth Earl Watson, Jr. (Age 42 of San Bernardino) with rape and other crimes.
In October of 2020, the Ontario Police Department investigated a sexual assault involving two male suspects in the area of Fourth Street and Cucamonga Avenue in the City of Ontario. During the investigation, Barnard Lamar Saddler and Kenneth Earl Watson were identified as suspects and eventually arrested.
After reviewing this case, our office has charged Mr. Saddler and Mr. Watson with the following violations of the California Penal Code:
Penal Code Section 209(b)(1) – Kidnapping To Commit Another Crime (Felony)
Any person who kidnaps or carries away any individual to commit robbery, rape, spousal rape, oral copulation, sodomy, or any violation of Section 264.1, 288, or 289, shall be punished by imprisonment in the state prison for life with the possibility of parole.
Penal Code Section 289(a)(1)(A) Sexual Penetration By Use of Force (Felony)
Any person who commits an act of sexual penetration when the act is accomplished against the victim’s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the victim or another person shall be punished by imprisonment in the state prison for three, six, or eight years.
Penal Code Section 287(c)(2)(A) – Forcible Oral Copulation (Felony)
Any person who commits an act of oral copulation when the act is accomplished against the victim’s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the victim or another person shall be punished by imprisonment in the state prison for three, six, or eight years.
Penal Code Section 211 – Robbery (Felony)
Robbery is the felonious taking of personal property in the possession of another, from his person or immediate presence, and against his will, accomplished by means of force or fear.
Penal Code Section 422 – Criminal Threats (Felony)
Any person who willfully threatens to commit a crime which will result in death or great bodily injury to another person, with the specific intent that the statement, made verbally, in writing, or by means of an electronic communication device, is to be taken as a threat, even if there is no intent of actually carrying it out, which, on its face and under the circumstances in which it is made, is so unequivocal, unconditional, immediate, and specific as to convey to the person threatened, a gravity of purpose and an immediate prospect of execution of the threat, and thereby causes that person reasonably to be in sustained fear for his or her own safety or for his or her immediate family’s safety, shall be punished by imprisonment in the county jail not to exceed one year, or by imprisonment in the state prison.
Penal Code Section 186.22(a) – Street Terrorism (Felony)
Any person who actively participates in any criminal street gang with knowledge that its members engage in, or have engaged in, a pattern of criminal gang activity, and who willfully promotes, furthers, or assists in any felonious criminal conduct by members of that gang, shall be punished by imprisonment in a county jail for a period not to exceed one year, or by imprisonment in the state prison for 16 months, or two or three years.
Penal Code Section 261(a)(2) – Rape (Felony)
(a) Rape is an act of sexual intercourse accomplished with a person not the spouse of the perpetrator, under any of the following circumstances:
(2) Where it is accomplished against a person’s will by means of force, violence, duress, menace, or fear of immediate and unlawful bodily injury on the person or another.
